            <p>EEBO-TCP aimed to produce large quantities of textual data within the usual project restraints of time and funding, and therefore chose to create diplomatic transcriptions (as opposed to critical editions) with light-touch, mainly structural encoding based on the Text Encoding Initiative (http://www.tei-c.org).</p>
            <p>The EEBO-TCP project was divided into two phases. The 25,363 texts created during Phase 1 of the project have been released into the public domain as of 1 January 2015. Anyone can now take and use these texts for their own purposes, but we respectfully request that due credit and attribution is given to their original source.</p>
            <p>Users should be aware of the process of creating the TCP texts, and therefore of any assumptions that can be made about the data.</p>
            <p>Text selection was based on the New Cambridge Bibliography of English Literature (NCBEL). If an author (or for an anonymous work, the title) appears in NCBEL, then their works are eligible for inclusion. Selection was intended to range over a wide variety of subject areas, to reflect the true nature of the print record of the period. In general, first editions of a works in English were prioritized, although there are a number of works in other languages, notably Latin and Welsh, included and sometimes a second or later edition of a work was chosen if there was a compelling reason to do so.</p>
            <p>Image sets were sent to external keying companies for transcription and basic encoding. Quality assurance was then carried out by editorial teams in Oxford and Michigan. 5% (or 5 pages, whichever is the greater) of each text was proofread for accuracy and those which did not meet QA standards were returned to the keyers to be redone. After proofreading, the encoding was enhanced and/or corrected and characters marked as illegible were corrected where possible up to a limit of 100 instances per text. Any remaining illegibles were encoded as &lt;gap&gt;s. Understanding these processes should make clear that, while the overall quality of TCP data is very good, some errors will remain and some readable characters will be marked as illegible. Users should bear in mind that in all likelihood such instances will never have been looked at by a TCP editor.</p>
            <p>The texts were encoded and linked to page images in accordance with level 4 of the TEI in Libraries guidelines.</p>
            <p>Copies of the texts have been issued variously as SGML (TCP schema; ASCII text with mnemonic sdata character entities); displayable XML (TCP schema; characters represented either as UTF-8 Unicode or text strings within braces); or lossless XML (TEI P5, characters represented either as UTF-8 Unicode or TEI g elements).</p>

                  <p>THat <hi>Henry Percy,</hi> Fifth Earl of <hi>Northumberland,</hi> had Iſſue Three Sons, <hi>viz. Henry, Thomas,</hi> and <hi>Ingelram.</hi>
                  </p>
                  <p>That <hi>Henry,</hi> the firſt Son, ſurviving his Father, became and was the Sixth Earl of <hi>Northumberland,</hi> but died without Iſſue.</p>
                  <p>That <hi>Thomas,</hi> the ſecond Son, had Iſſue Male, but all of them ſince dead. Nor is there any Iſſue Male living deſcended from the ſaid <hi>Thomas,</hi> the ſecond Son.</p>
                  <p>That <hi>Ingelram,</hi> the third Son, afterwards Sir <hi>Ingelram,</hi> had Iſſue <hi>Henry.</hi>
                  </p>
                  <p>That <hi>Henry,</hi> the firſt Son of <hi>Ingelram,</hi> had Iſſue <hi>James, William,</hi> and <hi>Henry.</hi>
                  </p>
                  <p>That <hi>James</hi> and <hi>William</hi> died without Iſſue Male.</p>
                  <p>That <hi>Henry,</hi> third Son of <hi>Henry,</hi> Grandſon of Sir <hi>Ingelram,</hi> had Iſſue <hi>Henry,</hi> and <hi>James,</hi> and <hi>Henry.</hi>

                  <p>That <hi>Henry,</hi> the firſt Son of <hi>Henry,</hi> died Young. And your Petitioner is <hi>James,</hi> the ſecond Son of the ſaid <hi>Henry</hi> the Father, who was Great Grandſon of the ſaid Sir <hi>Ingelram Percy.</hi>

                  <p>That the ſaid <hi>Joſceline Percy,</hi> the late Earl of <hi>Northumberland,</hi> died without Iſſue Male, and the Title, Dignity and Honor of <hi>Northumberland,</hi> is of Right deſcended to your Petitioner, as rightful Cozen, and next Heir Male of the ſaid <hi>Joſceline.</hi>
                  </p>
                  <p>That by taking away of the Court of Wards, Inquiſitions <hi>post mortem,</hi> inter<g ref="char:EOLhyphen"/>rupting the execution of the Heralds Office in the Times of the late Rebellion, tearing the Matches of the <hi>Percies</hi> out of the Heralds Books; undue Practices, in order to the ſtifling the Petitioner's Pedigree, ſecreting ſeveral of the Heralds Books from the Petitioner; and the want of the Aid of this High and Noble Court, your Petitioner is unable to Prove his Juſt Claim and Title to the ſaid Earldom, in ſuch manner as the ſtrictneſs of the Law requires, in order to his obtaining the ſaid Title, Dignity and Honor of Earl of <hi>Northumberland,</hi> unleſs aided and aſſiſted by this High and Noble Court of Chivalry.</p>

                     <hi>Your Petitioner therefore most humbly prays your Grace would be pleaſed to order the Heralds to produce and bring before Your Grace the Heralds Books and Records of Pedigrees, in order to the Clearing and Proving your Petitioner's ſaid Title and Claim; and to afford your Petitioner ſuch further Aid and Relief in the Premiſes, as to Your Grace, in Your Great Nobleneſs and Juſtice, ſhall ſeem meet. And your Petitioner ſhall ever Pray,</hi> &amp;c.</p>

Inſtant, in Anſwer to the Earl Marſhal's Order; to him who is ready to Pay the Fees belonging; and is re<g ref="char:EOLhyphen"/>ſolved, by God's Aſſiſtance, to remain a Friend to your Office and Officers, as Juſtice Commands and Requires,</p>

            <p>HIs Graces Order is very Good and Juſt, but it is to be feared there can be no full Proof made of the Petitioner's Pedigree, till theſe following Books be brought into Court alſo, to Compare with the Books of the Office; and Prays that His Grace will be pleaſed to Debate the whole Matter in that High and Noble Court of Chivalry; and then it will appear, that the Claimant Com<g ref="char:EOLhyphen"/>plains not of the Heralds Office, but of the Dutcheſs of <hi>Summerſets</hi> Agents, who Combined with Sir <hi>Edward Walker,</hi> King at Arms; which was the cauſe Juſtice was perverted near Eighteen Years. The Plaintiff, before he Fee'd his Proctor and Counſel, enquir'd of them if the Defendant, his Grace the Duke of <hi>Summerſet,</hi> or His Agents, had retained them: One ſaid, He had been ſpoke to by them; another ſaid, He was to go into the Country; and a third, He was fully Employ'd, but adviſed him to Plead in Court himſelf. I have retained Mr. <hi>Brown</hi> for my Proctor, and do moſt Humbly Pray that this High and Noble Court will be graciouſly pleaſed to appoint me ſuch an able Advocate as dares Plead for Juſtice.</p>
            <p>And further Prays for a Copy of the Anſwer; and in the next Order, that His Grace the Duke of <hi>Summerſet</hi> would be pleaſed to order Mr. <hi>Henry Champion,</hi> whoſe Father did, in the Kings Bench Court, at a Tryal there, make Oath and Declare, That Sir <hi>Ingelram Percy</hi> was Married, and had Sons and Daughters. And one Book at <hi>Cambridge,</hi> ſaith, Sir <hi>Ingelram Percy</hi> was Married, and had. And that Record, and any other Record tending to the Pedigree of <hi>Percy,</hi> may be produced in Court, and the next Order may be drawn up anſwerable to theſe following Miniuts. Alſo the Pedigree may be Confirmed by Your Grace in this High and Noble Court of Chivalry, it being the Property be<g ref="char:EOLhyphen"/>longing to that Noble Court only. Therefore all other Courts at Law and Equity, refuſes to Confirm the Pedigree, be the Proof never ſo Good.</p>

               <p n="5">5. Regiſter Books of ſeveral Counties and Towns.</p>
               <p n="6">6. Depoſitions in Chancery and Exchequer.</p>
               <p n="7">7. Warrants to Summons in Witneſſes, <hi>Viva voce.</hi>

               <p n="8">8. That Sir <hi>Orlando Gee, Henry Champion,</hi> Eſq; may bring in their Books and Records that properly Proves the Pedigree (of) <hi>Percy.</hi>

               <p n="9">9. That the Day of Hearing may be appointed.</p>

                  <hi>All theſe are Humbly offered to Your Grace, by Directions of Counſel, to pray an Order accordingly.</hi>

               <p>☞ The Book Printed the 31ſt of <hi>Auguſt,</hi> 1687. declares, How the Ho<g ref="char:EOLhyphen"/>nourable Judges of the Court of Common Pleas, adviſed the Plaintiff to apply himſelf to the other ſide, and that the Defendant, His Grace the Duke of <hi>Sum<g ref="char:EOLhyphen"/>merſet,</hi> if he pleaſed, might make his Propoſals in a Weeks time. But in lieu of Propoſals of Peace, you will find Impriſonments. Read the Book where is Five Letters writ by the Plaintiff to the Defendant, in Obedience to the Courts Direction: The firſt Letter to his Grace the Duke of <hi>Summerſet.</hi> The Se<g ref="char:EOLhyphen"/>cond to the Right Honourable <hi>Hugh</hi> Lord <hi>Clifford.</hi> The Third to Sir <hi>Orlando Gee,</hi> Knight. The Fourth to <hi>Henry Champion</hi> Eſq; The Fifth to <hi>Edward Bil<g ref="char:EOLhyphen"/>lingſley</hi> Eſq; But all ſilent, which forces the Plaintiff to pray for Juſtice. Ju<g ref="char:EOLhyphen"/>ſtice Glorifies God, Dignifies the Crown, Satisfies all Loyal Subjects, Reſtores the Oppreſſed, and will Crown this High and Noble Court of <hi>Chivalry,</hi> with the Lawrel of Fame to Future Ages; it being a good ſtep to Glory, when Truth and Peace kiſs each other. As I have been always Loyal, and joyful to ſee the King's Reſtauration, even ſo he Prays for a fair and ſpeedy Hearing before your Grace, in that High and Noble Court of <hi>Chivalry.</hi>
