            <p>EEBO-TCP is a partnership between the Universities of Michigan and Oxford and the publisher ProQuest to create accurately transcribed and encoded texts based on the image sets published by ProQuest via their Early English Books Online (EEBO) database (http://eebo.chadwyck.com).             <p>EEBO-TCP aimed to produce large quantities of textual data within the usual project restraints of time and funding, and therefore chose to create diplomatic transcriptions (as opposed to critical editions) with light-touch, mainly structural encoding based on the Text Encoding Initiative (http://www.tei-c.org).</p>
            <p>The EEBO-TCP project was divided into two phases. The 25,363 texts created during Phase 1 of the project have been released into the public domain as of 1 January 2015. Anyone can now take and use these texts for their own purposes, but we respectfully request that due credit and attribution is given to their original source.</p>
            <p>Users should be aware of the process of creating the TCP texts, and therefore of any assumptions that can be made about the data.</p>
            <p>Text selection was based on the New Cambridge Bibliography of English Literature (NCBEL). If an author (or for an anonymous work, the title) appears in NCBEL, then their works are eligible for inclusion. Selection was intended to range over a wide variety of subject areas, to reflect the true nature of the print record of the period. In general, first editions of a works in English were prioritized, although there are a number of works in other languages, notably Latin and Welsh, included and sometimes a second or later edition of a work was chosen if there was a compelling reason to do so.</p>
            <p>Image sets were sent to external keying companies for transcription and basic encoding. Quality assurance was then carried out by editorial teams in Oxford and Michigan. 5% (or 5 pages, whichever is the greater) of each text was proofread for accuracy and those which did not meet QA standards were returned to the keyers to be redone. After proofreading, the encoding was enhanced and/or corrected and characters marked as illegible were corrected where possible up to a limit of 100 instances per text. Any remaining illegibles were encoded as &lt;gap&gt;s. Understanding these processes should make clear that, while the overall quality of TCP data is very good, some errors will remain and some readable characters will be marked as illegible. Users should bear in mind that in all likelihood such instances will never have been looked at by a TCP editor.</p>
            <p>The texts were encoded and linked to page images in accordance with level 4 of the TEI in Libraries guidelines.</p>
            <p>Copies of the texts have been issued variously as SGML (TCP schema; ASCII text with mnemonic sdata character entities); displayable XML (TCP schema; characters represented either as UTF-8 Unicode or text strings within braces); or lossless XML (TEI P5, characters represented either as UTF-8 Unicode or TEI g elements).</p>

            <head>EXCEPTIONS to <hi>Edward Moſley</hi>'s BILL in Parliament.</head>
            <p>
               <seg rend="decorInit">T</seg>His is the third Bill (beſides a Petition before any of them) which <hi>Edward Moſley</hi> the Father hath brought in Parliament for the ſame matter in effect as this Bill was.</p>
            <p>
               <milestone type="tcpmilestone" unit="unspecified" n="1ſt."/> A Bill to the ſame effect was rejected on the Queſtion this Seſſion, 11. <hi>March</hi> laſt, as to Sir <hi>John Maynards</hi> Concernment, and yet was a juſter Bill then this; for that was to ſell to pay all the Debts, (which amount to many Thouſand Pounds) to which Debts and Legacies the whole Eſtate is ſubject in caſe of Redemption: and now by this Bill, the Creditours and Lega<g ref="char:EOLhyphen"/>tees ſhall be for ever abſolutely concluded.</p>
            <p>It is againſt the Fundamental Rules of the Houſe, after a Bill rejected, to admit any to the ſame effect under any pretence of Alterations; the Alterations here make this Bill worſe then the <gap reason="illegible" resp="#MURP" extent="1 word">

            <p>
               <milestone type="tcpmilestone" unit="unspecified" n="3ly."/> Sir <hi>John Maynard</hi> hath been many years in Chancery to have the Agreement performed, and hath at laſt a Decree.</p>
            <p>There Exceptions were taken to Sir <hi>John Coels</hi> Report, That the Security was too great; Councel heard on both ſides; the Exceptions referred to the Maſter, and to be final; the Maſter firſt and laſt was attended above twenty times; the Security adjudged and decreed to be equitable, and to be performed.</p>

            <p>All which run on, and yearly increaſe on him till 1673. and in the mean time he receives nothing.</p>
            <p>The Maſter reports, and the Court ſatisfied, that there was no other way to perform the Will of Sir <hi>Edward Moſley</hi> but this.</p>
            <p>Yet Sir <hi>John Maynard</hi> is Decreed to joyn in Sal<gap reason="illegible" resp="#MURP" extent="1 letter">

               <milestone type="tcpmilestone" unit="unspecified" n="4ly."/> The Bill is to overthrow the Decree as well as the Agreement, and other perſons to ſell to pay Sir <hi>John May<g ref="char:EOLhyphen"/>nards</hi> Debt.</p>

               <head>The Conſequence is unreaſonable and unjuſt.</head>
               <list>
                  <item>1. To take away or alter any mans Security againſt his will without his fault, contrary to Agreement under Seal and that ſo ſolemnly Decreed.</item>
                  <item>2. To re-examine a Maſters Report ſettled on proof, by Proceedings before a Committee.</item>
                  <item>3. To put all thoſe Creditors and Legatees to an uncertainty, and new Suits whoſe Debts and Legacies are now charged on Sir <hi>John Maynard.</hi>
                  </item>
                  <item>4. What if the new Truſtees will not Sell, or Sell this and another parcel of the Lands, and by that means ſpoil the Security, Selling the good and not the bad, and when they have Sold, not pay the Money, or take bad Se<g ref="char:EOLhyphen"/>curity, or detain the Moneys?</item>
               </list>
               <p>In theſe Caſes there is apparent miſchief and no remedy, or at beſt, new Suits and Troubles.</p>
               <p>
                  <milestone type="tcpmilestone" unit="unspecified" n="5ly."/> Sir <hi>John Maynard</hi> is to lay out the Money (not to receive it to his own uſe) but as a Truſtee, to Purchaſe Lands for Mrs. <hi>Maynard</hi> for her life, &amp;c. with Remainder to her Son an Infant, &amp;c.</p>
               <p>It is hard enough on her already, that her Life (which could not well be valued at above 7 years) and yet 6 years allotted for the Purchaſe thereof are already elapſed, and two years yet to come for Redemption.</p>
               <p>So that 8 years are already given to Purchaſe an Eſtate for her Life, and now more deſired.</p>
               <p>Sir <hi>John Maynard</hi> being by her and her Brother appointed for her Truſtee in the Security, others without her conſent ſhall be ſubſtituted.</p>
               <p>This 8000 <hi>l.</hi> was conceived by the Court to be in lieu of 8000 <hi>l.</hi> and of 2000 <hi>l.</hi> due to her by Aſſurances made by <gap reason="illegible" resp="#MURP" extent="1 span">

                  <milestone type="tcpmilestone" unit="unspecified" n="8ly."/> There is no need of this Bill in regard of the Infancy of <hi>Edward Moſley</hi> Junior, for a good Eſtate in Law and Equity may be made of the Lands to any Purchaſor, notwithſtanding any pretence of his in the Bill; for in Equity the Decree binds him, and in Law he hath no Title, becauſe the Eſtate in Law is out of him by breach of the Condition; for the time of laying out the 7000 <hi>l.</hi> elapſed in <hi>October</hi> laſt, the Condition being that the Father ſhould purchaſe within Five years, and within Five and a half ſettle Lands: The not purchaſing within five years was a breach.</p>
