WHereas the Kings most Excellent MAIESTIE, out of His Princely care of the health and safety of His Subiects, and to preuent the danger that might arise to them by their resort to London or Westmin­ster, about the occasions of the Terme, in times of Infection of the plague there, did therefore by His Proclamation dated the sixth day of September last, signifie His pleasure, that part of the Terme of Saint Michael then next comming, should be adiourned in and from the Vtas thereof, vnto the fourth Returne of the same Terme called Mense Michaelis next: Now His Maiestie finding that the sicknesse doth still continue and increase in those Cities and parts adioyning, and foreseeing that the danger thereof would be very great to His whole Kingdome, in dispersing the Infection, and would longer continue the perill there­of in those places already infected, by the concourse of so many from all parts of the Realme, whom the businesses of the Terme must necessarily draw together, doth therefore hereby declare His Royall pleasure to be, That at the said Returne called Mense, the said Terme be againe adiourned vntill Quindena Martini, being the last Returne of the same, and that to be for such causes only, and for such intents and purposes, as hereafter is expressed; And the same ad­iournement to be made from the last day of the said Returne of Mense Michaelis, called the day of appearance. And His Maiestie to auoid the dammage that may happen to His Subiects in their causes and suits, if the Terme should be wholly adiourned; Hath by aduice of his Coun­cell determined to haue some part thereof to be holden and continued, that is to say, for and during the seuerall Returnes of Octabis Michaelis, Mense Michaelis, and Quindena Martini onely, and for none other dayes or time whatsoeuer: And to that end His Maiesties will and Commandment is, [Page] that Writs of Adiournement shall be awarded by the Lord Keeper of the great Seale of England, directed to the Iustices of either Bench, and to the Iudges of all other His Maiesties Courts, to whom like Writs haue been vsually directed, Giuing them power to adiourne the said Terme againe, from Mense Michaelis next, vnto Quindena Martini, as aforesaid: wherein neuerthelesse His Maiesties intention is, that the same dayes may be held by one of the Iudges of each Court, onely for the better expediting and continuing of Causes and Suits, and returning and suing out of Proces, and for such other like things, as may be performed and done, in the absence of the parties by their Attourneys.

And therefore His Maiesty doth hereby declare His pleasure to bee, that in the said seuerall Returnes of Octabis Michaelis, Mense Michaelis, and Quindena Martini next coming, there shall bee no trialls by Iuries, or any Iudgements vpon Demurrers, or speciall Verdicts, or such like, in any of His Courts of Kings Bench, Common Pleas, or Exchequer: And also that there shall bee no Iudiciall hearing or determining of any causes or matters in any of His Courts of Starre-Chamber, Chancery, Exchequer-Chamber, Court of Wards, Dutchy-Chamber, or Court of Requests, during the said Returnes of Octabis Michaelis, Mense Michaelis, and Quindena Martini, respectiuely as aforesaid; And that no party shall need to be present in person for any such Causes or Suits, but the same may be attended and done by their Attourneys. And His Maiesty doth hereby further notifie and declare, that no party shall be compelled, or need to appeare in person in any of His Maiesties said Courts, at any time during the said Terme, but may make their appearance by their Attourneies, sauing only in Cases of Outlawry, and other the Cases mentioned in the Prouiso hereafter following: And also that no Iuries, or any whom the same may concerne, shall be compelled, or need to appeare in any of His Highnesse Courts at Westmin­ster at any time during the said Terme, for any Cause or matter whatsoeuer, vnlesse it bee for some speciall and important Cause, for His Maiesties seruice only. Prouided neuerthelesse, and His Maiesties pleasure and Commandment is, That all Collectours, Sheriffes, and other Ac­comptants, and all other persons that should or ought to accompt, or pay any summe or summes of money in any of His Maiesties Courts of Exchequer, Court of Wards and Liueries, or of His Dutchy of Lancaster, or in any of them, or enter into any accompt in any of the said Courts, shall re­paire to the accustomed places at Westminster, and there to pay, and do in euery behalfe, as though no such Proclamations or Adiournments had beene had or made.

And His Maiesties further pleasure and Commandment is, that all Sheriffes shall returne into His Maiesties Court of Exchequer, Court of Wards and Liueries, and Dutchy of Lancaster, all manner of Writs and Proces issued out of the same Courts, and returnable in Michaelmas Terme, which in any sort concerne His Maiesties Reuenues, Debts, or Duties, at, or before the dayes of Returnes thereof, into such Offices from whence the said Writs and Proces did issue: And that all Commissioners likewise returne all manner of Commissions and Inquisitions re­turnable the same Michaelmas Terme, and from the said Court sent, whereby His Maiestie is to receiue profit and commodity: And all Sheriffes, Collectours, and all manner of Accomp­tants, and euery person that is to pay any kinde of Debt or Duty vnto the Kings Maiestie in any of the said Courts; doe either by themselues, their Deputies or Attourneys, pay the same, in such sort as they ought to haue done, if no such Proclamations or Adiournements had been made; or else to sustaine such dammage of Issues, Seizure, Fine, Amerciament and Penalty be imposed vpon them, as hath beene accustomed, without any hope to be discharged thereof: [Page] And that all Sheriffes, by themselues, or their sufficient Deputies, shall giue their attendance at the dayes appointed for their opposall in the Court of Exchequer, to answere their Returnes be­fore His said Barons, as hath beene heretofore accustomed: And if any default shall be made by any of the persons aforesaid, that then (in respect of the Kings necessary and extraordinary char­ges) Sergeants at Armes, and Pursueuants shall be sent to bring them vp, to answere their Con­tempt and slacknes in paiment.

And for such of His Maiesties Subiects, as haue Cause to attend the Master and Councell of His Court of Wards and Liueries, to make their Compositions for Wardships, and suing out of Liueries, and other the businesses of that Court; His Maiesties pleasure is, that all such persons shall giue their attendance on the Master and Councell of the said Court at Acton, in the County of Middlesex, on Munday, being the fourteenth day of Nouember next; And so from time to time as that Court shall direct for dispatch of the businesse of the same Court.

And His Maiestie doth especially charge and require, as well the Lord Maior and Aldermen of the Citie of London, as the Iustices of Peace, and all other Officers and Ministers within Westminster, Middlesex, Surrey and Kent, to take especiall care, that as well the Orders lately pub­lished by His Maiesties direction, as such others as shall bee found necessary for preuenting the spreading of the Infection, bee from time to time strictly put in execution; And also, that all other the Iustices of Peace in all other Counties, Maiors, Bailiffes, and chiefe Officers of Cities and Townes Corporate, and other places within their seuerall Iurisdictions, be carefull to do the like, as there shall be occasion; As they tender His Maiesties Royall pleasure, and the common safety of His Kingdome and People in these times of danger.
